Terms of service.
Last updated: 23 April 2026 · Version 1.0
These terms govern your use of taowebservices.com and any services you engage from Tao Web Services Sdn Bhd (SSM: 202101040786 / 1441086-M, "we", "us"). By visiting the site or engaging us for a project, you agree to these terms.
1. Services
We provide web development, AI integration, custom software, IT support, and managed hosting (via our CircuitWP platform) to Malaysian businesses. Specific deliverables, timelines and pricing for any engagement are defined in a separate project proposal or statement of work that you sign before work begins.
2. Quotes and engagement
- Inquiries via this site or email are handled without charge. We typically respond within one business day.
- Once we scope a project, we issue a written fixed-price proposal with clear scope, timeline and payment terms.
- Work begins only after you accept the proposal in writing and pay the agreed upfront fee.
- Our proposals are valid for 30 days unless otherwise stated.
3. Payment
- Fees are quoted in Malaysian Ringgit (MYR) and are exclusive of SST unless stated otherwise.
- Typical payment structure: 50% upfront to begin work, 50% on delivery. Longer projects may use milestone-based payment.
- Invoices are due within 14 days of issue unless otherwise agreed.
- Late payment may incur interest at 1.5% per month on overdue amounts.
4. Intellectual property
- On full payment, you own the code, designs, and deliverables we produce specifically for you.
- We retain rights to our pre-existing tools, libraries, frameworks, and templates we use to build your project.
- Third-party components (WordPress, open-source libraries, paid plugins, etc.) remain subject to their own licences.
- We may reference your project in our portfolio and case studies, unless you request otherwise in writing.
5. Your responsibilities
To deliver your project on time, we ask that you:
- Provide content, feedback, and approvals within the agreed timelines.
- Give accurate information about your business, users and existing systems.
- Don't ask us to do anything illegal or that infringes on third-party rights.
- Pay invoices on time.
6. Revisions and changes
Our fixed-price proposals include a defined number of revision rounds. Additional revisions, or changes in scope, are charged at our current hourly rate or as a new fixed-price addition — agreed in writing before work begins.
7. Care plans and ongoing services
- Care plans are billed monthly or annually in advance.
- Either party may cancel with 30 days' written notice.
- Care-plan fees are non-refundable for the current billing period, but services continue until the end of that period.
8. Warranties and disclaimers
We deliver our services with reasonable skill and care. Beyond that, and to the fullest extent permitted by Malaysian law:
- The website and services are provided on an "as-is" basis without warranties of any kind, express or implied.
- We do not warrant that the site will be uninterrupted, error-free, or free from security vulnerabilities (though we take reasonable steps to minimise these).
- Information on this site is general in nature and does not constitute legal, financial or tax advice. Consult a qualified professional for your specific situation.
9. Limitation of liability
To the fullest extent permitted by Malaysian law, our total liability to you for any claim arising from or related to our services is limited to the total fees you paid us in the 6 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or punitive damages.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under Malaysian law.
10. Termination
- Either party may terminate a project for material breach by giving 14 days' written notice and opportunity to remedy.
- On termination, you pay for all work completed up to the termination date. We deliver all work-product that has been paid for.
- Upon termination of a care plan, we provide a 7-day handover window for exports, credentials and documentation.
11. Third-party services and affiliate links
The site mentions third-party tools (Bukku, Exabytes, Hostinger, Shopify, Cloudways, etc.). Some links to these tools are affiliate or referral links — see our affiliate disclosure for details. Your use of those third-party services is subject to their own terms, not ours.
12. Privacy
We handle your personal data in accordance with our privacy notice and Malaysia's Personal Data Protection Act 2010 (as amended 2024).
13. Governing law and jurisdiction
These terms are governed by the laws of Malaysia. Any dispute arising from or connected to these terms or our services is subject to the exclusive jurisdiction of the courts of Selangor, Malaysia. We encourage you to reach out before pursuing formal legal action — most issues can be resolved with a phone call.
